These Terms of Use govern the submission and publication of contributions on Innsbruck Momente. By submitting a pin, you accept these terms.
1. Purpose of the platform
The platform enables users to submit personal moments, memories and stories related to Innsbruck in the form of a map pin and to display them publicly.
2. Permitted content
Only content that is lawful and соответствует the purpose of the platform may be submitted.
In particular, the following are not permitted:
- offensive, discriminatory, glorifying violence, sexist or otherwise unlawful content,
- advertising, spam, political campaigns or commercial self-promotion,
- content containing personal data of third parties without sufficient authorization,
- content that infringes the rights of third parties, in particular copyright, trademark, personality or data protection rights.
3. Responsibility for content
The persons submitting the content are solely responsible for the submitted content. By submitting, you confirm that you are authorized to publish the content and that no rights of third parties are infringed. The contributions (pins) displayed on the map exclusively reflect the subjective assessments, memories and recommendations of the users who have created and submitted these contributions. Innsbruck Marketing GmbH does not adopt the content of the contributions as its own and assumes no guarantee for their accuracy, completeness, timeliness or usability. In particular, the published contributions do not constitute recommendations, information or assurances of the operator. The use of the information contained in the contributions is at your own responsibility.
4. Granting of usage rights
By submitting a pin, you grant the operator the simple, free of charge, non-exclusive right, unlimited in time and space, to store the contribution within the framework of the project “Innsbruck Momente”, to process it technically, to moderate it, to display it publicly on the map at www.innsbruckmomente.at as well as to translate it into the languages offered on the website and to share map excerpts and pins via social networks.
4a. Right to deletion and withdrawal
You can request the deletion of your published contribution at any time by providing your email address and the relevant contribution to the operator. The operator will remove the contribution from the map within a reasonable period of time. Upon deletion of the contribution, the usage rights granted under point 4 expire.
5. No entitlement to publication
There is no entitlement to the publication of a submitted contribution. Contributions may be reviewed, postponed, edited or deleted before or after publication if this is necessary to comply with these Terms of Use, legal requirements or to protect the project.
6. Moderation
Contributions may be moderated automatically and manually. The automated pre-check is carried out using AI-supported services from external providers; further information can be found in our privacy policy. As part of the automated moderation pre-check, a decision to reject a contribution may be made solely by automated means (Art. 22 para. 2 lit. a GDPR). The data subject has the right to obtain human intervention, to express their point of view and to contest the decision. Content that is classified as offensive, promotional, abusive or unclear may be rejected or postponed for further review.
7. Email confirmation
A contribution will only be further processed once the provided email address has been confirmed via the confirmation link sent. The confirmation must take place within 14 days after receipt of the confirmation email. Unconfirmed submissions will be automatically deleted after this period has expired.
8. Reporting and removal of content
If a published content violates rights or should be removed for other reasons, affected persons may contact the operator using the contact details provided in point 11. The operator will review such reports and, if necessary, remove or block contributions within a reasonable period of time. Likewise, submitters may request the deletion of their own contribution at any time in accordance with point 4a (right to deletion and withdrawal).
9. Liability
The operator strives to ensure a secure and uninterrupted operation of the platform. However, no guarantee can be given for the constant availability of the platform and the published content provided free of charge by the operator. The liability of the operator and the user is governed by statutory provisions. The operator is not liable for damages caused by slight negligence, unless they involve personal injury; in such cases, liability also applies for slight negligence.
10. Changes
These Terms of Use may be adjusted if this is necessary for legal, organizational or technical reasons. For new submissions, the version published at the time of submission shall apply. Contributions already published are subject to the Terms of Use applicable at the time of their submission. Significant changes affecting already published contributions will be communicated in advance to the respective users, provided their email address is still stored.

12. Applicable law and jurisdiction
Austrian law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods and the conflict-of-law rules of the IPRG.
